What is Arbitration?

Arbitration is a forum for settling disputes – contract and legal disagreements outside the court room. In the UK, the  Arbitration Act of 1996  empowers the Arbitrator to assist parties resolve their disputes.

Arbitration is thought to be a much simpler and inexpensive forum for resolving disputes.

Most commercial contracts will usually include an arbitration clause that will set out the disposal of disputes including the choice of arbitrators, the service of notices, the jurisdiction and other matters.

Arbitration clauses are legally binding contractual agreements that can be enforced without necessarily going through expensive legal proceedings

Arbitrators are independent, professionally qualified and skilled expert empowered through the Act or the contract to assess the evidence provided by parties and make a final and binding decision. The decision of the arbitrator is normally legally binding and can be enforced by the court.

Arbitration process can be complex and you may need assistance of a qualified solicitor or barrister who can advise on the following issues prior to engaging the Arbitration process:

  1. Tort – professional negligence
  2. Breach of contract in national or international trade disputes
  3. Partnership disputes
  4. Shareholders disputes

For instance, the majority of arbitration agreements involve a governing law clause, which specifies the area of law under which the agreement will operate. This can be either the law of England or Wales, etc. Naturally, you need to be aware of all the complexities, and the legal implications before you engage in the arbitration process.

It is therefore advisable that you seek the assistance of a firm of expert arbitration solicitors.
